Terms of Service

1. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service. By using the Service, you represent that you have the legal capacity to enter into these Terms.

2. Our service

Eazyshoot allows you to upload photographs of real people and receive AI-generated professional photoshoot images as the deliverable for your order. Where a specific package or theme states otherwise at checkout, some offerings may include additional human expert finishing steps.

You understand that:

• Outputs are AI-generated from your uploaded references and selected themes.
• Results depend on the quality, lighting, and composition of uploaded photos.
• We do not guarantee that every output will meet a specific artistic, commercial, or legal standard.

3. Consent and responsibility for uploaded photos

You may only upload photos or other content if you have the rights and permissions to do so.

By uploading any photo, you represent and warrant that:

• You captured the photo or otherwise own or control it.
• Every identifiable person shown has given consent for their image to be uploaded and processed through the Service.
• If multiple people appear in a photo, you obtained consent from each person before upload.
• If a person is a minor, you have valid consent from that minor's parent or legal guardian, or you are that guardian.
• Your use of the Service does not violate any law, contract, privacy right, publicity right, or third-party right.

4. Prohibited uses

You may not use the Service to:

• Upload or process photos without the consent required under these Terms.
• Impersonate another person or misrepresent your identity or authority.
• Create deceptive, harmful, abusive, defamatory, harassing, exploitative, or unlawful content.
• Generate sexualized content involving minors or content that exploits, endangers, or harms children.
• Infringe intellectual property, privacy, publicity, or other rights.
• Use the Service for fraud, misinformation, identity theft, stalking, or harassment.

We may suspend or terminate access for any use that violates these Terms or creates risk to people, rights, or the Service.

5. User content

"User Content" means photos and other material you upload or submit. You retain ownership of your User Content. You grant Eazyshoot a limited, non-exclusive, revocable license to host, copy, process, and transmit User Content only as needed to operate the Service and deliver your order. We do not claim ownership of your uploaded photos or generated deliverables.

6. Generated deliverables

Subject to your compliance with these Terms and applicable law, you may use the images delivered for your order for personal or commercial purposes unless we state a narrower license for a specific feature or plan at checkout.

You are solely responsible for how you use deliverables, including ensuring that your use:

• does not violate law;
• does not infringe third-party rights;
• does not mislead others about what is real or AI-generated where disclosure is required by law or platform rules.

Because AI systems may produce similar results for different users, we do not guarantee exclusivity or uniqueness of outputs.

7. Data retention and deletion

We retain uploaded reference photos, generated outputs, and related order records for as long as reasonably necessary to:

• fulfill and deliver your orders;
• provide account access to your order history and downloads;
• respond to support requests;
• maintain the security and integrity of the Service; and
• meet legal, tax, accounting, fraud-prevention, and dispute-resolution requirements.

Abandoned funnel upload drafts and unpaid checkout sessions may expire and be deleted automatically after the periods shown in the Service.

You may request deletion of your account-related data or specific uploads and outputs, subject to limits where we must retain information for legal, security, or unfinished order obligations. Submit requests using the contact details in Section 18 once a support email is published, or through any in-product deletion or privacy request option we make available.

We may update our detailed retention practices from time to time. Material changes will be reflected in our Privacy Policy and, where required, communicated through the Service.

8. Privacy

Your use of the Service is also subject to our Privacy Policy at https://eazyshoot.com/legal/privacy. If there is a conflict between the Privacy Policy and these Terms regarding data handling disclosures, the Privacy Policy controls for privacy matters; these Terms control for service use and payment matters.

9. Fees and payments

Paid orders are priced per checkout. The amount shown at checkout for your selected package, themes, and options is the price you agree to pay. Payments are processed by Razorpay (UPI, cards, wallets, netbanking, and other methods Razorpay supports).

• Fulfillment for your order begins after we successfully verify payment (including through our payment verification flow or Razorpay webhooks).
• Unpaid orders expire if payment is not completed within 48 hours. Expired unpaid orders are cancelled and fulfillment does not start.
• Because deliverables are digital goods produced after payment, fees are non-refundable except where required by applicable law or where we expressly state otherwise in writing.
• We may change pricing for future orders prospectively. Price changes do not affect orders already placed.

10. Account security

If the Service requires an account, you are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us promptly of any unauthorized access or suspected breach once a support contact is published.

11. Service availability

We may modify, suspend, or discontinue all or part of the Service at any time, with or without notice. We do not guarantee uninterrupted availability, error-free operation, or continued support for any feature.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

We do not guarantee that the Service will meet your expectations, that outputs will match a specific vision, or that the Service will always be secure or uninterrupted.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EAZYSHOOT AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) INR 4,000.

14. Indemnification

You agree to defend, indemnify, and hold harmless Eazyshoot and its affiliates, officers, employees, and service providers from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your User Content, your breach of these Terms, your violation of law, your failure to obtain valid consent from any person shown in uploaded photos, or your infringement of any third-party right.

15. Termination

We may suspend or terminate your access at any time if we believe you violated these Terms, created legal or security risk, or misused the Service. Upon termination, your right to use the Service ends immediately. Sections that by nature should survive termination will survive, including ownership, disclaimers, limitation of liability, indemnity, and governing law.

16. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms and update the effective date above. Your continued use of the Service after the updated Terms take effect constitutes acceptance of the revised Terms.

17. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law principles. You agree that courts located in India will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service, except where applicable law requires otherwise.
